糟糕，您的商标已注册！

前言

各位，不及早注册商标的代价也许是很高的。

业界领头羊Sony PlayStation是家喻户晓，就连不是电玩爱好者都知道的品牌。 (2)  2013年索尼发布的“PlayStation 4”（或俗称“PS4”）成为历史上销售最快的游戏机。而让人期待已久的“PS5”预计于2020年11月推出。

虽然“PS5”将主导下一代电玩游戏，但PS5在印度却面临着一个尴尬的局面：“PS5”品牌已在印度注册为商标，但该商标并非由索尼公司注册。

据报道，一位名为Hitesh Awani的德里居民于2019年10月在当地申请注册了“ PS5”。(3) 索尼第一次发布PlayStation 5的消息是在2019年4月发布的(4)，而在2019年10月已经确认了其硬件规格(5)，然而没人知道为什么索尼没有更早提交商标注册申请文件。

目前，索尼有几种选择，包括挑战或获取Awani的注册或将“PS5”名称更改为其他名称。无论哪种方式，索尼都会付出一定的代价。目前，“ PS5” 可能无法在地球第二人口大国印度预售(6)，并且发布日期尚不能确定。

付费使用或被迫更改

彰显预先注册商标的重要性的案例有很多。很多品牌在不得已的情况下，修改其在另个国家的商标。

这里有一些例子：

Burgerking当汉堡王试图将其业务扩展到澳大利亚时，“汉堡王”已经被阿德莱德的一家外卖食品商店注册为商标。(7)
结果，汉堡王澳大利亚的特许经营者采用了以下商标：

Zenfone6由于另一人注册了相似的商标，因此印度德里高等法庭禁止华硕使用Zen为其产品打上商标(8)。结果，华硕将ZenFone 6重命名为“ ASUS 6Z”。
TJMaxx当TJX公司扩展到英国和爱尔兰时，美国商店决定将其名称更改为“ TK Maxx”，以避免与另一家知名的百货公司TJ Hughes产生混淆(9)。
Penneys为了避免被美国零售商J.C. Penney.(10)提告，爱尔兰的公司更名为“ Primark”。
